Arguably, Fabolous' baby's mother and her father ceded the moral high ground when they refused to press charges, presumably because they thought they could somehow get some money from Fabolous.
Fabolous and his baby's mother aren't married, so if they broke up she probably wouldn't get anything other than child support, which would be based upon how much he made from that Freddie vs. Jason album, i.e. maybe nothing at all.
If Fabolous had any sense, he'd kick her to the curb, lock in a tolerable child support amount (it's only right that he takes care of his own kids) and be done with it.
