Free Gerardo Flores

Pictured above is a young fellow named Gerardo Flores. As a high school student in Lufkin, TX, he enjoyed drinking beers and playing soccer and often looked forward to the day when he would graduate from college and finally be able to make a better life for himself and his numerous, numerous relatives. Instead, he now looks to spend the rest of his life behind bars. His crime: Helping his girlfriend get an abortion.

Sez the AP:

LUFKIN, Texas -- A 19-year-old East Texas man faces a life prison sentence for causing his teenage girlfriend to miscarry twins, even though she wanted to end the pregnancy.

Gerardo Flores was accused of causing the miscarriage by stepping on his girlfriend's stomach. He was prosecuted under the state's new fetal protection law.

Erica Basoria acknowledged asking Flores to help end her pregnancy. But the 17-year-old can't be prosecuted because of her legal right to abortion.

The defense contended that Basoria punched herself while Flores was stepping on her, making it impossible to tell who killed the twins.

The jury reached a verdict after deliberating four hours. Because prosecutors declined to seek the death penalty in the case, Flores received the automatic life sentence.

Now, I can acknowledge the fact that what young Mr. Flores and his woman decided to do is not the easiest or even the cleanest way to get rid of a set of twins, but at the same time I can understand how a young couple in that situation might end up making such a decision. I mean, it's better that a kid like him save his money for school so that he might one day be able to provide for a family than for him to be taking his $300 down to the tall Israelis at Planned Parenthood.

In a country where there is no publicly subsidized abortions for the unfit (as there should be), what other options were there, really? Only a fascist country like the United States of Amerikkka would force a woman to carry a pregnancy to term just because she couldn't afford the other, best option.

2) the law works in an innocent until proven guilty basis. it is inconclusive who was responsible. so even if you think he should be put in prison forever if he did do this, its irrelevant because it has not, according to what ive read, been proven beyond a reasonable doubt that he was responsible.

once again, im confouned by peoples views on abortion. if you choose to have sex, as Dude stated, than you have no choice BUT to carry that baby. The formation of the fetus is the result of 'unprotected' sex, or as i like to call it: sex. Its not like you have sex and then 'Oh shit? a baby? well i never expected this to happen!'
Therefore the government isnt forcing women to do anything, they choose to undergo in an activity that LOGICALY makes them pregnant. If anything, NATURE is forcing her to carry that baby. there should be no saftey net in such a case.

i think its unfortunate that they made the decesion they made, and even more unfortunate that only one of them has to go to jail. but what they did was wrong, and disgusting, and should not be blamed on a country which doesnt support free killing (and furthermore shouldnt support killing you pay for).

I agree. Key phrase being "him AND her" I mean, she wasnt raped here, she CHOSE to have sex w/ some dude and CHOSE to ask him to help her end her pregnancy just like she CHOSE to punch her stomach. If you read the article that Bol linked to, flores' lawyer says he plans to appeal the case as far as he can take it, ideally to the supreme court. Hopefully it makes it that far cuz somewhere along the lines the law got f'd up when it declared it A-OK to crush ur unborn fetus while sending someone to prison for life for doing the exact same thing per the woman's request.

No, I think the reason women have the right to get an abortion is b/c it's a woman's body and she should have the right to not push a baby out of her pussy if she doesn't want to. (But of course, this could also be accomplished by not getting knocked up in the first place).

I never said it was his fault exclusively. The girl certainly had responsibility as well. First let me say that the action was wrong - BUT

It clearly shows to me as European that Your system is wrong. The young couple should have been offered help - clearly they were under stress, and what can you expect from poor 17/19 year old kids...

1) Your system was Wrong in the first place - leaving the young couple little choise is such a desperate situation.

2) Their lives (and families) lives are spoiled for good

3) Now the Country will have to pay for his time in Prison - and he will not contribute to society

4) And even if You agree - how come the girl got off???

I grew up with this guy. We were best friends and often slep at each others house when we were kids. I moved from Lufkin, TX about a year before this happened and couldn't believe this when I heard about this. The fact that he was given such a harsh punishment and the girl got away free pissed me off. He is to this day the best friend I have ever had and one of the nicest people. When I look back it could have been me or any other teenager who is scared and not thinking straight. It makes me feel like shit when I think of him behind bars for at least 40 years for a strupid adolecent mistake and I live in Las Vegas enjoying life. I just wish there was smethig I could do. Sorry Jerry I dont even know what to say to you man. All I can say is stay strong.
